Disclosure of Information to Food Stamp Agencies Required by Public Law; 96-249

 

  1. Purpose. To inform SESA's of an omission to draft language that was attached to UIPL 52-80 for use in
    implementing the requirement for disclosure of information to food stamp agencies.

  2. References. Section 127 (b), Public Law 96-249; Section 303 (d), Social Security Act; Unemployment Insurance Program Letter 52-80.

  3. Background. UIPL 52-80, September 22, 1980, included among other matters an explanation of the requirement in P.L. 96-249 for disclosure of information by State agencies to food stamp agencies. Page 5, second Paragraph, explains that information is to be released only if satisfactory arrangements are made for the requesting agency to reimburse for the costs involved. That position is based on the provisions of Section 303 (d) (I) (A) of the Social Security Act which specifically requires that disclosure of the requested information be made only on a reimbursable basis. However, the requirement for such reimbursement was inadvertently excluded from the draft language to implement this Federal provision. The attachment to this letter includes a change to the draft language provided on page 8 of UIPL 52-80 which adds an additional subsection establishing that an agreement to reimburse is a condition that must be satisfied before such information will be released. (See revised language in Subsection (d).)

  4. Action Required. SESA's are requested to substitute the attached page 8 for the page 8 contained in UIPL 52-80 and to retain this change 1.

Draft Language to Implement P.L. 96-249--Disclosure of Information to Food Stamp Agencies, Effective January 1, 1983.

  1. The (name of State agency) shall disclose, upon request, to officers and employees of the U. S. Department of Agriculture and any State food stamp agency, with respect to an identified individual, any of the following information which is contained in its records:

  2. The term "State food stamp agency" means any agency described in Section 3 (n) (1) of the Food Stamp Act of 1977 which administers the food stamp program established under such Act.

  3. The requesting agency shall agree that such information shall be used only for purposes of determining the applicant's eligibility for benefits, or the amount of benefits, under the food stamp program established under the Food Stamp Act of 1977.

  4. The information shall not be released unless the requesting agency agrees to reimburse the costs involved for furnishing such information.

  5. In addition to the requirements of this (section, subsection, paragraph), all other requirements with respect to confidentiality of information obtained in the administration of this Act and the sanctions imposed for improper disclosure of information obtained in the administration of this Act, shall apply to the use of such information by the officers and employees of any food stamp agency or the U.S. Department of Agriculture.
